Welcome to use the products and/or services provided by BYD Europe B.V. on BYD Cloud Classroom (BYD Auto Learning and Management System). Our registered address is ['s-Gravelandseweg 256, 3125 BK Schiedam, the Netherlands], and the BYD Cloud Classroom Privacy Policy ("Policy") applies to the products and services we provide on BYD Cloud Classroom.

We attach great importance to the protection of the personal information of our users (hereinafter referred to as "you").

This policy describes the purpose, manner, scope, legal basis and information security protection measures for collecting, using, storing, sharing, and transferring your personal information in the products or services we provide to you on the platform, as well as the rights and methods we offer you to access, update, delete and other control of your personal information.

This policy will help you understand the followings:

In particular, this policy does not apply to services provided to you by other third parties on BYD Cloud Classroom nor to products or services for which separate legal notices and privacy policies have been established.

1.What Personal Information Do We Collect

Personal information means all kinds of information, recorded electronically or otherwise, that can identify a specific natural person or reflect the activities of a particular natural person, either alone or in combination with other information. We will only collect your personal information based on your consent or other legal basis according to the applicable laws and regulations for the following purposes described in this policy, or we will seek consent again.

Basic business functions

1) Registration

To help you register for BYD Cloud Classroom so that we can provide you with relevant services, you will need to provide your name, country of residence, company name, position, and work email address to create an account on the platform. You need to change the initial password we provide when you log in for the first time.

2) In order to provide you with a better learning experience, we need you to provide some information and associate it. This information and corresponding functions include:

a. Mandatory Monthly Course

During the learning process, when you take the initiative to evaluate the products/services of the course or post other contents (such as satisfaction assessment of the course, evaluation, praise, and star rating of the courseware), and add study notes during the learning process, the platform will collect your name, and the administrator can view all the study notes of this courseware and delete the unqualified ones.

b. My Courses

You can enter the course list in this module and see completed courses, courses in progress, and optional courses.

During the learning process, when you take the initiative to evaluate the products/ services of the course or post other contents (such as satisfaction assessment of the course, evaluation, praise, and star rating of the courseware), and add study notes during the learning process, the platform will collect your name, and the administrator can view all the study notes of this courseware and delete the unqualified ones.

c. My Exam

The platform will collect your exam information; the exam creators and exam proctors will be able to mark your exams.

3) When you use the BYD Cloud Classroom platform, such as the the login system, and Online Courses module, the following information may be collected from you for service purposes:

a. Log information, which means technical information that may be automatically captured by the system through cookies and other technologies or otherwise when you use our Services, including device or software information, such as configuration information provided by your mobile device, web browser, or other program used to access our Services, your IP address, and the version and device identifier used by your mobile device.

b. Information contained in content you share through our Services (metadata), such as the date, time, or location of shared photos or videos taken or uploaded.

c. Call records, when you contact us, we may keep information such as your correspondence/call records and contents or the contact information you leave to contact you or help you solve the problem, or record the solution and result of the relevant issue.

d. We may also collect the following data about you: Data such as the date and time of access when you use our services.

Please note that information such as device information and log information alone cannot identify a specific natural person. If we combine such non-personal information with other information to identify a particular natural person or use it in combination with personal information, such non-personal information will be treated as personal information during the period of combined use, and we will anonymize and de-identify such personal information unless we obtain your authorization or unless otherwise required by law or regulation.


2. How We Use Your Personal Information


The information we collect in the course of providing our services to you may be used in the following ways:

1) Your personal information will be used for the purposes listed in the "How we collect your personal information" section.

2) Providing you with security

To improve the security of your use of the services provided by us and our partner (system server provider Oracle Corporation), to protect your personal and property safety or that of other users or the public from infringement, to better prevent phishing apps, fraud, network vulnerabilities, computer viruses, network attacks, network intrusion, and other security risks, and to more accurately identify violations of laws and regulations or the rules of BYD's relevant agreements, we may use or integrate your registration information, device information, relevant network logs, and the information authorized by you or shared in accordance with the law to our affiliates and partners, to make comprehensive judgement of your account, identity verification, detection and prevention of security incidents, and take the necessary records, audit, analysis, disposal measures by the law.

3) To improve our services or to provide more accurate services.

3. How We Use Cookies and Similar Technologies

Cookies

To ensure the site works correctly, we store small information files called cookies on your computer or mobile device. Cookies usually contain an identifier, the site’s name, and some numbers and characters. Cookies allow websites to store information such as your preferred products.

When third parties are given access to your personal data, we will take the required contractual, technical and organizational measures to ensure that your personal data are only processed to the extent that such processing is necessary.

If your personal data are transferred to a recipient in a country that does not provide an adequate level of protection for personal data, we will take measures to ensure that your personal data are adequately protected, such as entering into EU Standard Contractual Clauses or UK international data transfer agreement with these recipients.

In other cases, your personal data will not be supplied to third parties, except where required or allowed by law.

International Transfer

In principle, personal data we collect is stored in the countries of your place of residence or within the European Economic Area or UK. However, BYD is a global company, and we operate internationally, this means we may access information from BYD's headquarters in China, which supports the provision of services. By submitting your personal data to us, your information may be transferred to BYD in the countries other than your place of residence or in which the information was originally collected. BYD complies with laws on the transfer of personal data between countries to help ensure your personal data is protected as described in this Statement, wherever it may be.

For transmitting data to recipients outside the European Economic Area or UK, we ensure that your data is adequately protected by signing the data transmission agreement adopted by the European Commission (e.g., EU Standard Contractual Clauses (SCCs) or UK international data transfer agreement(IDTA)) with the recipients and (if necessary) adopting other additional appropriate technical measures, organizations and measures (e.g., encrypting your data) or taking other measures to provide sufficient data).

5. How We Store Your Personal Information

The personal information we collect and generate will be stored in Paris, France. We will only retain your personal information for as long as necessary to achieve the purposes described in this policy unless an extension of the retention period is required or permitted by law. We will maintain your registration information as long as your account is necessary for service provision.

Please note that when your application to delete your BYD Cloud Classroom account succeeds, we will complete the review of your account deletion within

48 hours of your application. After the application is approved, we will delete or anonymize your personal information.

If we discontinue the operation of products or services, we will notify you of the discontinuation in the form of one-by-one delivery or announcement and delete or anonymize your personal information after discontinuing the operation of products or services.

We may need to retain your personal information or part of it for an extended period of time in the following circumstances, and only for purposes related to:

1) Compliance with applicable laws and regulations and other relevant provisions.

2) To comply with the requirements of court judgement, decisions, or other legal proceedings.

3) To comply with the requirements of the relevant governmental or other authorized authorities.

4) For purposes reasonably necessary to enforce the relevant service agreement or this policy, to protect the public interest, to process complaints/disputes, and to protect the personal and property safety or legitimate rights and interests of our customers, our or our affiliates, other users or employees.


6. How We Protect Your Personal Information

Security Measures We have Taken

We have used security measures by industry standards to protect the personal information you provide against unauthorized access, public disclosure, use, modification, damage, or loss of data. We will take all reasonably practicable measures to protect your personal information. We use encryption technology to ensure the confidentiality of data; we use trusted protection mechanisms to prevent malicious attacks on data; we deploy access control mechanisms to ensure that only authorized personnel has access to personal information, and we conduct security and privacy training courses to enhance employee awareness of the importance of protecting personal information.

We will use secure encryption technology to protect your personal information during transmission. Take all appropriate organizational, management, and technical measures to protect the security of the personal information you provide in our internal organization.

The Internet is not an absolutely secure environment. Since e-mail, instant messaging, and communication with other users are not encrypted, we strongly recommend that you do not send personal information through such means. Please use complex passwords to help us ensure the security of your account.

We will update and disclose the security risk, personal information security impact assessment report, and other related contents from time to time, which you can obtain through BYD Cloud Classroom announcements.

7. Your Rights

Following the requirements of the GDPR , relevant laws, regulations, and standards of the EU member states or UK and the prevailing practices of other countries and regions, we guarantee that you exercise the following rights concerning your personal information.

Access to your personal information

To the extent required by applicable law, you have the right to access your personal information. If you wish to exercise your right of access to information, you may do so in the following ways:

If you wish to access or edit profile information in your account, change your password, add security information,you may do so by accessing the Software's Personal Hub feature.

For other personal information generated during your use of our products or services, we will provide it to you as long as we do not require excessive input.

If allowed by applicable laws, you have the right to withdraw your consent at any time when BYD processes your personal data based on your consent. However, withdrawal does not affect the legitimacy and effectiveness of how we process your personal data based on your consent before the withdrawal is made; nor does it affect any data processing based on another justification other than your consent.

If you wish to exercise your right of access to information, please send an email to the email address we provide in 9. How to Contact Us and we will respond to your request within reasonable period according to the regulations.

Restriction, Correction and Portability of your personal information or object to process your personal information.

Deletion of your personal information

You may request us to delete personal information in the following cases.

1) If our processing of personal information violates laws and regulations.

2) If we collect and use your personal information without your consent.

3) If our processing of personal information violates the agreement with you.

4) If you no longer use our products or services, or if you cancel your account.

5) If we no longer provide products or services to you.

Responding to Your Request

You may be required to provide a written request or otherwise prove your identity for security purposes. We may ask you to verify your identity before processing your request. please send an email to the email address we provide in 9. How to Contact Us to realize all of your rights as above.

We will respond to your request within one month after receiving it. If you are unsatisfied, you can also complain in the following ways.

These rights may be limited in some situations–for example, where we can demonstrate that we have a legal requirement to process your data or if making the information available to you would reveal personal data about another person or if we are legally prevented from disclosing such information. In some instances, this may mean that we are able to retain data even if you withdraw your consent.

8. Updates to this Policy

We may revise this policy in a given certain period. When the terms of this policy are changed, we will show you the changed guidelines in the form of a push notification when you log in again and when the version is updated. Please note that we will only collect, use, and store your personal information by the revised guidelines if you click the consent button. We will not reduce your rights under this policy without your express consent. We will post any changes made to this policy on this page.

We will also provide more prominent notice of material changes (including, for certain services, email notification of specific changes to this policy).
